Excerpt: ...original or final process, and shall desire to be released from arrest or imprisonment by delivering up his property, the marshal or other oflicer having the custody of such person shall take him before some commissioner of the court, whose duty shall be to conform, as near as may be, to the duty of the judge or oflicer acting under the laws of this state in like cases; and the same proceedings shall be had before such commissioner as are required by the laws of this state. See as to release in such cases, and privilege of jail limits, §$991-2, U. S. Rev. Stat, page 135.. Execution. No. 17. Whenever the court shall continue in session ten days after any decree or judgment shall be rendered, and no motion shall be made, or proceeding had, to supersede, arrest or set aside the same, the party shall be 0 entitled as of course to his execution upon application to the clerk. This rule has been superseded by the adoption of the practice of the State Court; but it is to be noticed that under section 987 U. S. Revised Statutes, the court may on entering judgment on application of eithel party, in its discretion stay execution for forty-two days, to give time to file a petition for a new trial. And that under section 1007 of Revised Statutes, as amended by act of Feb. 18, 1875, in all cases where writ of error may be a supersedeas, exe.u' tion shall not issue until expiration of ten days after the rendition of judg ment.
